Competition Law in Norway | Nr. 1/2018 – 2017 in review and what to expect in 2018

2017 was another busy year for competition law in Norway with the NCA issuing two decisions imposing fines and carrying out three confirmed dawn raids, the Supreme Court also handed down its judgement in Ski/Follo Taxi which tackles the thorny issue of joint tendering as a by-object restriction.

On the merger control side, the NCA conducted several in-depth examinations of complex transactions that were authorised unconditionally, demonstrating that intricate issues can be resolved through dialogue with the merging parties. Nonetheless, the NCA did prohibit a merger in Eimskip/Nor Lines and the Ministry upheld the NCAs decision to prohibit the Dolly Dimple’s/Peppes Pizza merger.
