Our Dispute Resolution team is pleased to present the latest edition of BAHR Dispute Resolution Insight!

In this edition, our litigators take a closer look at the upward trend of ventilating climate change-related grievances before the courts. The development signals that neither corporations nor governments are beyond the reach of claimants seeking to stave off the adverse effects of climate change, and that international commitments are not only “for show”.

Another development that we explore in this edition is parties’ exposure to liability under Norwegian law for disloyal conduct in contractual relationships. Although it has long been clear that disloyal conduct in contractual dealings can, in theory, result in liability, such arguments may often appear as last-ditch. Is this about to change?
