Intellectual Property | New trade secrets act enters into force on 1 January 2021

The new Norwegian act on the protection of trade secrets enters into force on 1 January 2021. This was announced on Friday 11 December 2020. The main purpose of the act is to implement Directive (EU) 2016/943 (the EU Trade Secrets Directive).

The act is to a great extent in line with existing Norwegian law. Norwegian law on the protection of trade secrets is, however, somewhat fragmented and the proposed act compiles the rules on the protection of trade secrets in a single new act, and represents a welcome clarification of the legal position of trade secret holders. As always, it is of outmost importance for businesses – especially within the technology domain – to take appropriate steps in order to protect their own trade secrets and to avoid being accused of infringing the trade secrets of others. Additionally, all agreements concerning information disclosure should be carefully considered.
